By virtue of the present petition, the petitioner seeks transfer of the application under Order IX rule 13, Code of Civil Procedure (CPC) in M/s Valo Automotive Pvt. Ltd. vs. M/s V Go Motors Pvt. Ltd. bearing case no. Misc. DJ/20/2024 as also ancillary reliefs.

The primary contention of the learned counsel for the petitioner is that though a similar application has been filed before the Learned District Judge, Karkardooma Court, however, since the Learned District Judge has since been elevated, the said position is vacant as of now and therefore the said application is not being taken up/ listed. Additionally, he submits that due to aforesaid reasons, he is unable to withdraw the said application and take appropriate steps.

the present petition for seeking an appropriate direction. 4.

Considering the peculiar facts and circumstance involved there is no need felt for issuance of notice to the other side and the same can be dispensed with.

The officiating District and Sessions Judge, Karkardooma District Court, Delhi is requested to take up the said application filed by the petitioner on 28.07.2025 in T.P. Civil 40/25 at the earliest to dispose of the same as expeditiously as possible, preferably within a span of four weeks, in accordance with law.

Accordingly, in view of the aforesaid, the present petition alongwith the accompanying applications stands disposed of in the aforesaid direction.

A copy of the order be sent to officiating District and Sessions Judge, Karkardooma District Court, Delhi for information and compliance.
