The present petition under Sections 12 and 14 of the Contempt of Courts Act, 1971, seeks the following prayers:- "i. Initiate appropriate civil contempt proceeding against the Contemnor No. 1 to 6 namely Sh. Raihan Ahmed, Sh. Ashok S. Rana, Sh. Jawahar Singh Deswal, Ms. Shaheen Ahmed, Ms. Saira Banu, and S. H. 0. Ps. Hauz Qazi for willful disobedience of the order dated 12.12.2023 passed by Sh. Kartik Taparia, the then Ld. Civil Judge-02, Central District, Delhi in Civil Suit No. 2068/2023 titled Nooruddin V /s Mohd. Salim and may further be pleased to summon, prosecute and punish the Contemnor above named accordingly in accordance with law.

ii. The Hon'ble Court may further be pleased to direct the Respondent No. 1 to 6 to restore the possession of the suit property bearing House No. 692, Ground Floor, Gali Kundewalan, Ajmeri Gate, Delhi-110006 consisting of two Rooms, Kitchen, Latrine and common Bathroom to the Petitioner forthwith.

iii. Any other order/s which this Hon'ble Court may deem fit and proper be also passed in favor · of the Plaintiff and against the Defendants."

It is pointed out that the order dated 12.12.2023 of which the compliance has been sought for in the present petition has since been set aside by order dated 06.09.2025. Learned counsel appearing on behalf of respondent Nos.1, 4 and 5 has handed up in Court today order dated 06.09.2025 passed in 7/Misc/SCJ 36/25 titled as "Nooruddin vs. Mohd. Salim" wherein, it has been recorded as under: - "9. In view of the aforesaid reasons, the order and decree dated 12.12.2023 passed by Sh. Kartik Taparia, Ld. Predecessor of this Court in Civil Suit No. 2068/2023 matter titled as Nooruddin vs. Mohd. Salim are hereby set aside as the same appears to have prima facie to have been obtained by the plaintiff and the defendant acting in collusion since Mr. Raihan Ahmed and Ms.

Saira Banu Khan (applicants) appear to have published a public notice in Newspaper Indian Express New Delhi Edition on 10.11.2023 that the GPA in favour of defendant/Mohd. Saleem had been revoked. Therefore, there is a strong suspicion that the defendant acted fraudulently in collusion with the plaintiff on 12.12.2023 which led to the decree dated 12.12.2023. The application under Order 23 Rule 3 r/w Section 151 C.P.C. stands disposed off accordingly."
