O R D E R

The present petition has been filed on behalf of the petitioners seeking quashing of FIR No. 229/2021 registered under Sections 498-A/406/506/34 IPC at P.S. Kirti Nagar, Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and the petitioner No. 1 (husband) whereas the petitioner Nos. 2 and 3 are the mother-in-law and the sister-inlaw of the complainant/respondent No. 2, respectively. 3.

Learned APP for the State submits that in the present case, the petitioners are the only accused persons and the respondent No. 2 is the complainant/victim. He further submits that the charge-sheet has been filed in the present FIR.

Learned counsel for the petitioners submits that the petitioner No. 1 and the respondent No. 2 have settled their disputes vide MOU dated 29.04.2024, a copy of which has been placed on record. In terms of the said settlement, the petitioner No. 1 and the respondent No. 2 have already been granted divorce by mutual consent vide divorce decree dated 27.07.2024 passed by the Principal Judge, Family Courts, West, Tis Hazari Courts, Delhi in HMA No. 2012/2024.

Petitioner No.1, who is present in Court and identified by the I.O., undertakes that the rights of their two minor children, namely, Chitransh and Kiyansh, who are in the custody of the respondent No.2, shall remain unaffected by the terms of the settlement. In acknowledgement of his statement made in Court today, petitioner No.1 as well as his counsel have signed the present order sheet.

The petitioners and the respondent No.2, who are present in Court, have been identified by their respective counsels as well as by the I.O./ SI Kaplianthang, P.S. Kirti Nagar.

Respondent No. 2 submits that she has settled her disputes with the petitioner No.1 out of her own free will, volition and without any coercion. She further submits that she has no objection in case the present FIR is quashed against the petitioners.

Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.

With the above directions, the petition is disposed of alongwith miscellaneous application.
