After hearing the arguments for some time, learned counsel for the petitioner states that she may be permitted to withdraw the present petition with liberty to file appropriate application seeking amendment in the suit pending before the learned Trial Court.

In view of the above, the present petition is disposed of as not pressed. All the rights and contentions of the parties are reserved. 3.

Needless to say, as and when such application is filed by the petitioner/plaintiff, the same would be considered by learned Trial Court in accordance with law and also keeping in mind the fact that the request of the plaintiff to withdraw the suit has specifically been declined by the learned Trial Court itself.
