On 02nd February 2024, the order directing inquiry against the Managing Committee came to be set aside with directions given to the Registrar of Cooperative Societies to conduct inquiry afresh after affording an opportunity of hearing.

It is the contention of the learned senior counsel for the petitioners that the Administrator came to be appointed without affording an opportunity of hearing or without issue of Show Cause Notice. 3.

disputed by the learned counsel for the respondent no.1/Registrar of Cooperative Society ('RCS'), upon instructions from Mr. Satish Kumar Gupta, Assistant Registrar of Cooperative Society, 4.

In that view of the matter, the order impugned appointing the Administrator is hereby quashed and set aside. 5.

We permit the respondents to take recourse to the appropriate proceedings in view of the observations made in paragraph 18 of the Order dated 02nd February, 2024 passed by the Financial Commissioner afresh. 6.

Needless to clarify that the proceedings must receive with an opportunity of hearing to the petitioner.

The petition, accordingly, stands partly allowed in the above terms. 8.

Pending applications, if any, stand disposed of. 9.
