On 27.02.2024, this Court had passed the following order:- "Perusal of order sheets dated 29.12.2023 and 23.01.2024 indicate that learned counsel for the Petitioner had offered to pay back Rs. 8 lacs to the Complainant and on this assurance, notice was issued to the Complainant, who has appeared in Court, despite being aged, ailing and on a wheelchair. However, during the course of proceedings, Petitioner now seeks to go back on the assurance given and offers to pay only Rs.2 lacs, with a request to give more time to clear the balance. This conduct of the Petitioner cannot be appreciated, more particularly, when the Complainant has travelled all the way with his disabilities only with a hope that he would get his money back.

List on 22.04.2024 for hearing."

Order sheets prima facie indicate that applicant has made every endeavour and effort to deprive the complainant of the money due to him. 3.

At this stage, learned counsel for the applicant seeks to withdraw the present application.
