% 30.01.2024 I.A. 1978/2024 (u/Order XXIII Rule 3 r/w Section 151 of the Code of Civil Procedure, 1908) 1.

This is a joint application on behalf of the Plaintiff and the Defendant No.1 seeking a consent decree. The terms of the settlement have been elaborated in paragraph no. 3 of the instant application. 2.

Counsels for Plaintiff and Defendant No.1 confirm the settlement and pray that the suit be decreed in terms thereof. The aforenoted application is duly supported by affidavits of the authorised representatives of the parties. The counsels who have joined the proceedings confirm the settlement and identify the signatures of their clients and pray that the suit be decreed in terms of the settlement, as recorded in para 3 of the application. 3.

The Court has perused the terms of the settlement, as recorded in paragraph No. 3 of the said application, and finds the same to be lawful. Parties shall remain bound by the terms and conditions of the settlement. 4.

The application is allowed and disposed of.

Counsel for the Plaintiff, on instructions, states that they do not wish to press any relief against Defendant No. 2 and accordingly the said party is deleted from the array of parties.

Let an amended memo of parties be filed within a period of one week from today.

The suit is decreed in favour of the Plaintiff and against Defendant No. 1 in terms of the settlement recorded in paragraph no. 3 of I.A. 1978/2024, which shall form part of the decree. 8.

Decree sheet be drawn up.
