The present petition under Section 24 of the CPC seeks following prayer:- "It is therefore most humbly prayed that this Hon'ble Court may kindly be pleased to transfer the above noted Civil Suit titled as Mahesh Chand Sharma v. Khan Chand Mehta which was numbered as CS No. 103/2022 to before District Judge Shahdara for further adjudication, in the interest of justice."

Learned counsel for the petitioner/plaintiff submitted that the aforesaid suit, CS No.103/2022, was filed on behalf of the latter, seeking possession, recovery of arrears of rent, mesne profit and permanent injunction against the present respondent, before the learned District Judge-02, North-East District, Karkardooma Courts, Delhi.

Learned counsel for the petitioner has further submitted that the respondent had raised an issue with respect to the territorial jurisdiction of the learned Trial Court, since the suit property falls under the jurisdiction of PS The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Jafrabad. It is submitted that for administrative purposes, PS Jafrabad falls under North East District, and, for judicial purposes, PS Jafrabad falls under Shahdara District and in order to avoid complications in the adjudication of the said suit, the same can be transferred from the Court of learned District Judge-02, North East District, Karkardooma Courts to the concerned learned District Judge, Shahdara District, Karkardooma Courts, Delhi. 5.
Learned counsel appearing on behalf of the respondent/defendant has fairly submitted that he has no objection, if the said suit is transferred to the concerned learned District Judge, Shahdara District, Karkardooma Courts. 6.
In view of the above, the present petition is allowed. Suit, CS No.103/2022, pending before the Court of learned District Judge-02, NorthEast District, Karkardooma Courts, Delhi, is transferred to the Principal District Judge, Shahdara District, Karkardooma Courts, Delhi, who shall assign the same to the Court of competent jurisdiction. Let the records of the said suit be transferred to the concerned Court within a period of 10 days. The parties are directed to appear before the concerned Court accordingly. 7.
It is clarified that the learned Transferee Court will proceed with the suit from the stage at which it is being transferred. 8.
Pending application(s), if any, also stand disposed of accordingly. 9.
Copy of the order be sent to the learned Principal District Judge, Shahdara District, Karkardooma Courts, Delhi, for necessary information and compliance.
