The Petitioner is aggrieved by the denial of Pilot License under Airline Transport Pilot License1.

Pertinently, Respondent No.2 vide order dated 7th November, 2017 finding the Petitioner guilty of adopting unfair means in Pilot License Examination 2010 (October session), debarred him from appearing in the Pilot License Examination for three years and suspended his Pilot License bearing no. 4539 under the APTL category. The said order was challenged before multiple forums but to no avail. Thereafter, the Petitioner appeared in in the Pilot License examination in 2023. the requisite examination and yet, the license has been denied. To this effect, he highlights several representations made by them to Respondent No. 2 commencing from 11th December, 2023.

Since there is no formal decision taken on such representations informing Petitioner about the reasons for denial, in the opinion of the Court, at the first instance, Respondent No. 2 must deal with Petitioner's representation and pass a speaking order conveying their decision on such representations to Petitioner.

With the above directions, the present petition is disposed of, along with pending applications. Respondent No. 2 is directed to decide Petitioner's representation dated 11th December, 2023 within four weeks from today. In the event, the decision is adverse to Petitioner's interest, he shall be at liberty to assail the same, in accordance with law. 5.
