% 21.02.2018 CM No.6687/2018 By way of this application, restoration of CM No.4581/2018 is sought. Upon notice, learned counsel for second respondent draws the attention of this Court to the order of 7th February, 2018 wherein while noting the submission of second respondent to the effect that the payment has been made as per decision of 27th September, 2017, this application was dismissed in default as none had appeared on behalf of petitioner. Learned counsel for applicant/petitioner submits that the payment has not been made as per the decision of 27th September, 2017. The averments made in application provide sufficient cause to restore CM No.4581/2018. The application is allowed and CM No.4581/2018 is restored to its original position.

CM No.4581/2018 Petitioner's counsel submits that copy of this application would be supplied to learned counsel for respondent No.2 during the course of the day. Response, if any, be filed within 4 weeks. Rejoinder thereto be filed within two weeks thereafter.
