This is a petition under Section 29A of the Arbitration and Conciliation Act, 1996 ["the Act"], for extension of the mandate of a sole Arbitrator, who is in seisin of disputes between the parties pursuant to a Memorandum of Understanding dated 16.03.2016. 2.

Notice was issued in this petition on 03.01.2024. 3.

Further to the order dated 03.01.2024, Mr. Vikrant Singh Bloria, learned counsel, enters appearance on behalf of Mr. Pankaj Khaitan, the Interim Resolution Professional ["IRP"] appointed by the National Company Law Tribunal in respect of respondent No.1- Concept Horizon Infra Pvt. Ltd. He states that the IRP has no objection to the relief sought in this petition.

For the aforesaid reasons, the petition is allowed and the time to conclude the proceedings is extended for a period of one year from today. 6.

Ms. Raymon Singh, learned counsel for the petitioner, states that the petitioner has some apprehension regarding the appearance of Mr. Bloria on behalf of IRP as he is also appearing for the ex-management of respondent No.1-company. The ex-management are separately impleaded in the arbitral proceedings in their individual capacity, and were represented by Mr. Sushant Tomar, who is also associated with Mr. Bloria's office, on the last date of hearing. However, there is no objection to Mr. Bloria's appearance for the purposes of this petition. The objection, if any, is reserved for consideration by the learned Arbitrator. 7.

The petition, alongwith pending application, is disposed of.
