The Petition under Section 528 of BNSS, 2023 has been filed on behalf of the petitioner with the prayer that the learned Judicial Magistrate First Class (Mahila Court-01), South-East District, Saket Court, New Delhi, be allowed to dispose of the application under Section 23 of the DV Act for interim maintenance for the petitioner within two weeks from the date of the Order of this Petition.

Learned counsel for the respondent has appeared on advance notice, has submitted that the petitioner is a 28 year old daughter holding U.K. citizen and since 2022, is working. maintenance has been sought for the period 2018 to 2022 when she was studying/unable to work because of COVID pandemic. It is also submitted that a similar application had been filed before the learned trial court, which has been dismissed. The application is vehemently opposed as it is already listed for consideration on 21.10.2024.

The matter is already listed for 21.10.2024 before the Trial Court which is barely a month and a half from today. No directions in the circumstances as detailed above, are warranted because the Court is sensitive about these matters and try to make best endeavour to dispose of the Applications, as expeditiously as possible. No directions are required. 7.

The Petition is disposed of accordingly. The pending application also stands disposed of.
