This application has been filed under Section 438 of the Code of Criminal Procedure, 1973 (in short, 'CrPC') praying for grant of Anticipatory Bail in FIR No. 0039/2023 registered with Police Station, Crime Branch, Delhi under Sections 419/420 of the Indian Penal Code, 1860 and Sections 66C/66(D) of the Information and Technology Act, 2000.

On 04.01.2024, this Court had passed the following order:- "2.

The applicant, who is present in person, undertakes to pay the entire balance amount to the complainant within a period of one month from today.

The undertaking is accepted.

4.

List on 8th February, 2024.

5.

In case the payment is not made, the applicant shall remain personally present in Court on the next date of hearing."

The learned counsel for the applicant admits that the applicant is not in a position to comply with his undertaking. also not present in person, though the matter has been called out thrice. The learned counsel for the applicant submits that the applicant is on his way. This Court cannot keep on waiting endlessly for the applicant to appear.

Though this may even amount to a contempt of Court, I refrain from taking further action against the applicant on this account. It is, however, evident that the applicant is only misusing the process of the Court, earlier before the learned Additional Sessions Judge and now before this Court.

Accordingly, the application is dismissed.
