This application under Section 151 CPC has been filed on behalf of the Plaintiff for withdrawal of the instant suit being CS(OS) 706/2024 in view of Order dated 04.02.2025 in Civil Appeal No.(s).2551/2022 passed by the Apex Court in view of compromise dated 03.02.2025 arrived at between the parties before the Apex Court.

Material on record indicates that the Apex Court had referred the matter to Mediation and the Mediator appointed by the Apex Court was successful in settling the disputes between the parties and Civil Appeal No.(s).2551/2022 has been disposed of in terms of the compromise dated 03.02.2025 recorded by the Apex Court.

Since the dispute no longer survives, the instant application is allowed.
