O R D E R

% 13.02.2026 CONT.CAS(C) 16/2024 1.

This is a contempt petition filed under section 10 and 12 of the Contempt of Courts Act, 1971 for violation of the directions in order dated 27.09.2018 passed by this court in WP (C) NO. 403112018. 2.

The order dated 27.09.2018 reads as under:

"As a last opportunity, the respondent No.5/Delhi Development Authority (for short 'DDA') is granted four weeks' time to file the counter affidavit with an advance copy to counsel for the petitioner, who may file rejoinder thereto, if any, before the next date of hearing. Renotify on 06.02.2019.

In the meantime, the DDA shall maintain status quo in respect of the subject land falling in Khasra No.301 (8-04) and 493/302 (4-01), Village Ladha Sarai, New Delhi." 3.

Mr. Gupta, learned counsel for the petitioner states that the land in question is the private land of the petitioner and the respondent DDA has erected a wall and thereafter, there has been unauthorized encroachment on his land.

Ms. Takiar, learned standing counsel for DDA, on instructions states, that in view of the order dated 0.09.2012 of the Hon'ble Supreme Court, the respondent is not seeking the ownership of the land falling The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In this view of the matter, the petitioner is at liberty to take appropriate steps to protect his land and the wall enclosing the land can be demolished by the petitioner.
