The present Petition has been filed impugning the order dated 12.02.2024 passed by the learned ARC-01, Central District, Tis Hazari Courts, Delhi [hereinafter referred to as the "Impugned Order"]. 2.

By the Impugned Order, the learned Trial Court has held that the triable issues have arisen and allowed the leave to defend filed by the Respondent.

After some arguments, learned Counsel for the Petitioner submits that he wishes to withdraw the present Petition with liberty to raise all contentions before the learned Trial Court. He submits that he will not take any unnecessary adjournments before the Trial Court. 4.

Without prejudice to the rights and contentions of the Petitioner, the Petition and all pending Applications are dismissed as withdrawn with liberty as prayed for.
