This petition has been filed under Article 226 of the Constitution of India seeking a writ in the nature of mandamus against the respondent not to disturb the position of the petitioner and not to dispossess the petitioner from the site i.e. near B-58, Public Toilet, B-Block, Main Road, Budh Nagar, Inderpuri, New Delhi. Learned counsel for respondent has filed a short counter affidavit and a photograph has been annexed to show where the petitioner claims to be squatting i.e. outside a public toilet. Learned counsel for the petitioner, after some hearing, submits that the petitioner would be satisfied in case a direction is issued to Town Vending Committee, as and when constituted, to would also consider her case. He, however, prays that merely because she is not found squatting at the site in question, her case

may not be rejected. Ms. Kalra, learned counsel for the respondent no. 1, without admitting any of the averments made in the petition, submits that as and when Town Vending Committee is constituted the case of the petitioner would be considered in case the application is made along with supporting documents. Merely because the petitioner is not found squatting would not be a ground alone to reject her case.

In view of the stands taken by the parties, the writ petition is disposed of. However, we make it clear that we have not expressed any opinion on the merits of the case.
