% 14.03.2018 The petitioner is seeking parole for the reasons mentioned in the petition. One such reason is that he wants to file a SLP against the dismissal of his appeal which had been decided on 18.05.2015. On advance notice, learned counsel for the State has put in appearance. It is pointed out that the conduct of the petitioner has not been satisfactory; the punishment meted out to him on 13.06.2017 has been noted in the nominal roll. It is further pointed out that the petitioner had jumped parole on one occasion and had to be rearrested only after a gap of one month. A status report to the said effect has also been filed. Learned counsel for the State submits that the address of the petitioner stands verified. This Court notes the rejoinder submission of the learned counsel for the petitioner which is

to the effect that the petitioner has not availed benefit of either furlough or parole since the last 1- 1⁄2 year. He undertakes that he should surrender before this Court after the expiry of this parole period. This Court also notes that the in this entire period of incarceration of almost 8- 1⁄2 years, the petitioner has availed parole only on one occasion. Record further reflects that his sentence has been modified and from life imprisonment, it has been brought to 10 years out of which he has already suffered incarceration of 8- 1⁄2 years.

Accordingly, petitioner is admitted to parole for a period of three weeks to be counted from the date of his release on furnishing of his personal bond in the sum of Rs 10,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent with condition that he shall surrender himself before the Jail Authorities immediately on the expiry of the aforenoted period of three weeks; he shall appear before the concerned SHO on every Monday of every week; he shall also furnish his latest residential address and mobile number to the concerned investigating officer. Petition is disposed of in the above terms.

A copy of this order be sent to the Jail Superintendant concerned for intimation to the petitioner.

Order dasti.
