% 22.03.2016 The present is an application under Section 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.) read with Section 482 Cr.P.C. seeking interim bail on the ground of serious ill-health of the father of the applicant. Counsel appearing on behalf of the applicant states that the medical condition of the latter's father is critical and it has been opined by the doctors attending to the latter that the chances of his survival are slim. Counsel however, limits the scope of the present application to a direction to the Superintendent, Central Jail, Tihar to escort the applicant in custody to visit his father at Asian Institute of Medical Sciences, Faridabad, Haryana or at his residence at Faridabad, Haryana.
Mr. Oberoi, learned APP appearing on behalf of the State has filed a status report. The same is taken on record.
A perusal of the status report reveals that Shri Giriraj Sharma, the father of the applicant has been admitted on 15.03.2016 in ICU of Asian Institute of Medical Sciences, Faridabad Haryana. However, Mr. Oberoi would urge that the petitioner be not enlarged on bail in view of the circumstance that he has jumped bail on an earlier occasion.
In view of the foregoing facts and circumstances, since the father of the
applicant is stated to be in a critical medical condition, the present application is allowed. The Superintendent, Central Jail, Tihar is directed to escort the applicant in police custody to the Asian Institute of Medical Sciences, Faridabad, Haryana or the residence of the applicant in Faridabad, Haryana for the next three days i.e. 23.03.2016, 24.03.2016 and 25.03.2016 between 10.00 a.m. and 05.00 p.m. and return him to the jail premises safely. It is further directed that the officials accompanying the applicant shall be attired in plain clothes. The said officials may seek police assistance from the SHO of the concerned police station in Faridabad, Haryana in this behalf. With the above directions, the application is disposed of. A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
