CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 16.07.2020 [Court hearing convened via video-conferencing on account of COVID-19] I.A.No.4752/2020 1.
Allowed, subject to the applicant curing the deficiencies referred to in the captioned application within five days of the lockdown qua this Court being lifted.
I.A.No.4744/2020 2.
Mr. Deepak Khosla, who appears on behalf of the applicant i.e. Mrs. Kumkum Talwar, says that since the review petition [i.e. Review Application No. 101/2020], against the judgement dated 24.02.2020, passed by my predecessor, in CS(OS)Nos.1321/2006, 1435/2006, 1137/2014 and 2161/2015, has been dismissed on 23.06.2020, the captioned application has been rendered infructuous.
3.
That being said Mr. Khosla points out in the prayer clause of the captioned application, the application numbers adverted to therein, have been wrongly mentioned. Mr. Khosla says that the correct application numbers are I.A. Nos. 4603/2020 and 4624/2020 and not I.A. Nos. 4063/2020 and 4064/2020.
4.
Mr. Khosla says that the correct application numbers i.e. I.A. Nos. 4603/2020 and 4624/2020 are given in paragraph 2 of the captioned application.
5.
The record would show that I.A. No. 4624/2020, being an exemption application, has already been disposed of vide order dated 18.06.2020. 6.
Accordingly, having regard to the statement made by Mr. Khosla, which has been recorded in paragraph 2 hereinabove, the captioned application is disposed of.
I.A.No.4603/2020 7.
Mr. Khosla, who appears on behalf of the applicant i.e. Mrs. Kumkum Talwar says that, in sum and substance, by way of the captioned application, the applicant i.e. Mrs. Kumkum Talwar seeks permission of this Court to move to the concerned Court i.e. the coordinate bench for recalling the consent decree dated 03.01.1996 passed in CS(OS)No.824/1993. 8.
It is not disputed by Mr. Khosla that he has moved an application before the coordinate bench for recall of the aforementioned decree dated 03.01.1996. 8.1 The aforementioned application, according to Mr. Khosla, is numbered as I.A. No. 4604/2020.
9.
In my view, no permission of this Court, in that behalf, is required.
10.
The applicant, having already moved an application before the coordinate bench, the coordinate bench, without doubt, will pass appropriate orders on the same as per law.
11.
The captioned application is, accordingly, dismissed. RAJIV SHAKDHER, J JULY 16, 2020 Aj/KK Click here to check corrigendum, if any
