The present writ petition has been filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), praying as under: - "a. issue a 'writ of certiorari or any other appropriate writ, order or direction thereby setting aside the rejection order No. F.18/102/2003/2024II/2406-2420, dated 15.10.2024 as passed by the Respondent by accepting the recommendation/minutes of meeting of SRB held on dated 23.02.2024 and rejecting the premature release of the Petitioner;

b. issue writ of mandamus or any other writ, order or direction for premature release the petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

c. Pass such other and further orders/directions, as may be required in the interest of justice, and is deemed fit and proper in the facts and circumstances of the case."

The Petitioner was sentenced for life imprisonment along with fine for the offences punishable under section 302/34 Indian Penal Code, 1860 in case FIR No. 442/2008 at registered at Police Station Welcome, on 23.09.2010.

The petitioner is aggrieved by the rejection of his application seeking pre-mature release. Petitioner's case for premature release was considered by the respondent authorities along with 77 other cases and was rejected vide order dated 15.10.2024.

The learned Additional Standing Counsel for the State submits that the last meeting of the Sentence Review Board ('SRB') was held on 16.10.2025 where 62 cases were considered for pre-mature release.

He submits that the petitioner's case has again been sent for re-consideration on 01.10.2025. He submits that the petitioner's case along with other eligible cases will be considered in the next meeting to be held by the SRB. 6.

It is pointed out that the SRB meetings are scheduled every quarter and therefore petitioner's case is likely to be considered in the next meeting which is likely to take place in the month of January, 2026.

Considering the above, this Court does not find it apposite to keep the present petition pending.
