The learned counsel for the petitioner seeks liberty to withdraw the present petition to approach the Civil Court to file an appropriate suit/proceedings claiming the title and right over the subject property.

The present petition is dismissed as withdrawn. 3.

It is, however, clarified that in case any such proceedings are filed by the petitioner, the same would be decided uninfluenced by the observations made in the order dated 06.04.2023, passed by the learned SDM, Narela, under Section 145 of the Code of Criminal Procedure, 1973.
