O R D E R

% 14.03.2018 1.

The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that an Arbitral Tribunal be constituted to adjudicate the disputes that have arisen between the parties in respect of a "Contract For Security Service Arrangement" dated 09.02.2016 (hereafter 'the Agreement') . 2.

The Agreement contains an arbitration clause, which is set out below:- "SETTLEMENT OF DISPUTE AND JURISDICTION

1. Any dispute and or differences arising out of or relating to this Contract shall be resolved between the CARS24 Services and Sea Gate within the period of 30 days from the date of the dispute arisen and if the same could not be resolved within the said period, then the dispute will be referred to Arbitration as per the Arbitration and Conciliation Act, 1996.

2. Both parties agree to subject all legal matters pertaining to

this Contract to Delhi State Jurisdiction only." 3.

The learned counsel for the petitioner had invoked the arbitration clause by a notice dated 18.01.2018. The learned counsel appearing for the respondent states that the respondent has no objection if an Arbitral Tribunal is constituted. The learned counsel appearing for the parties further submit that the parties are willing for the Arbitrator to be appointed and the arbitration to be conducted under the Rules of Delhi International Arbitration Centre (DIAC).

With the consent of the parties, it is directed that a Sole Arbitrator be appointed by the DIAC. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The parties are directed to appear before the Coordinator, DIAC on 22.03.2018 at 11:00 AM.
