The present petition under Section 11& 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a) Initiate contempt proceedings against the respondent for not complying the order dated 28/04/2025 passed by this Hon'ble court in W.P.(C) NO. 5453/2025, titled as "SH. VIKRAM SARDANA VS MUNICIPAL CORPORATION OF DELHI & ORS.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 28.04.2025 passed in W.P.(C) 5453/2025, the following directions were passed: - "5. Accordingly, it is directed that the MCD and SHO, Police Station Adarsh Nagar, shall ensure that no further unauthorised construction is carried out in the properly in question, which shall be stopped, forthwith.
6. Requisite action shall be taken against the unauthorised construction after following the due process, and in accordance with law.
7. In cash, the petitioner is aggrieved by any non-action on the part of the MCD, he shall be at liberty to approach the Special Task Force ("STF") constituted by the Supreme Court, in terms of the directions, as passed by the Division Bench of this Court in the cases of Devender Versus Govt, of NCT of Delhi, in W.P.(C) 1807/2018 and Fazruddin Versus DDA in W.P.(C) 4649/2017." 5.
Learned counsel appearing on behalf of the MCD on advance notice submits that vide order dated 14.07.2025 the property no. 222, Block-B situated at Indra Nagar, Near Adarsh Nagar, Delhi-110033 has been regularised under self assessment scheme. A copy of the said order has been handed up in the Court today and has been taken on record. A copy of the same has been supplied to the learned counsel for the petitioner who seeks leave to withdraw the present petition with liberty to take appropriate steps in accordance with law.
