Petition under Article 227 of the Constitution of India has been preferred on behalf of the petitioner with following prayers: "(a) · Issue a writ of certiorari or any other appropriate writ, order, or direction to the Ld. MM Court to directions Order to the Ld. MM. Court to urgently hear and decide the application dated 03.08.2023 seeking-payment of school fees and other expenses of the minor child expeditiously in a time bound manner and redress the unnecessary delay in the administration of justice and the extreme financial hardships faced by the Petitioner. (b) Direct the Respondent to clear the arrears of maintenance, school and education fees, medical expenses of the minor child etc. immediately being duty bound as the father of the minor child. (c) Direct the Ld. MM Court to finally decide the Domestic Violence Complaint No.

12606/2018 in a time bound manner which is pending adjudication before the Ld. MM for last 06 years and the Ld. Learned counsel for petitioner submits that present petition has been preferred to expedite hearing of application preferred by petitioner before learned MM, seeking payment of school fees and medical expenses of the minor child which could not be decided, despite passage of considerable time. 3.

A perusal of the order dated 14.08.2024 reflects that learned trial court appears to be sensitive to the aforesaid aspects but on account of procedural delays could not finally dispose the said application for enhancement of interim maintenance as well as application for seeking education and medical expenses of the minor child.

Considering the facts and circumstances, learned trial court is directed to make an endeavour to conclude the hearing on the aforesaid applications on the date already fixed before it on 23.09.2024 and pass appropriate orders in accordance with law within four weeks thereafter. Petition is accordingly disposed of. Pending applications, if any, also stand disposed of.

A copy of this order be forwarded to learned trial court for information and compliance.
