Allowed, subject to the appellant filing legible copies of the annexures, at least three (03) days before the next date of hearing. EFA(OS) 16/2024 & CM APPL. 51560/2024 2.

This appeal is directed against the judgment and order dated 06.08.2024, passed by the learned Single Judge. 3.

Mr M G Vacher, learned counsel, who appears on behalf of the appellants i.e., judgment debtors 2&3, says that the directions concerning disclosure of assets have been issued by the learned Single Judge without giving an opportunity to the appellants to file a reply. 4.

According to us, that does not seem to be the purport of the impugned judgment and order dated 06.08.2024.

4.1 Since notice has been issued, quite logically, the appellants i.e., judgment debtors 2&3 would have an opportunity to file a reply. 5.

The impugned judgment and order seems to be indicative of certain information that has been sought which, in any case, the Court is empowered to do.

Nevertheless, we are inclined to dispose of the appeal, granting opportunity to the appellants i.e., judgement debtors 2&3 to file a reply to the subject application i.e. EX. APPL. (OS) 1200/24 preferred by the respondent no. 1/decree holder.

6.1 The reply would be filed within the next three (03) weeks. 6.2 Rejoinder thereto, if any, be filed before the next date of hearing. 7.

Since the subject application is listed before the learned Single Judge on 06.12.2024, learned Single Judge will consider the reply before proceeding further in the matter.

The appeal is disposed of in the aforesaid terms. 9.

Pending application shall stand closed.
