Notably, civil suit no. CS (OS) 683/2022 is pending before this Court. The petitioner by way of the instant application under section 24 of CPC seeks transfer of probate case no. PC-40/2022 to be tried along with CS(OS) 683/2022.

In the prima facie opinion of this Court, the application filed before this Court can be pressed in the pending civil suit no. CS OS) 683/2022 and the concerned Court would be in a better position to appreciate the facts and circumstances involved in the aforesaid case as the Court is already seized with the main issue. More so, in the said civil suit, the parties have already been appearing and therefore, at this stage, without expressing any opinion on the merits or otherwise, the Court grants liberty to the petitioner to take necessary steps for filing appropriate application in civil suit no. CS (OS) 683/2022.
