Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to challenge the Complaint Case No. 618/2024 under Sections 138/142 of Negotiable Instrument Act, 1881 (hereinafter referred to as the "NI Act") of learned JMFC.

The record shows that the Complaint under Section 138 NI Act was filed on 20.01.2024 and the Petitioner was summoned vide Order dated 31.05.2024.

Essentially, the grounds to seek the quashing of FIR can also be raised while challenging the Summoning Order.

The Petition alongwith pending Applications, is permitted to be withdrawn with liberty to approach the Court of Sessions in accordance with law.
