This is a petition under Section 528 BNSS, 2023 read with Article 227 of the Constitution of India, for quashing of cognizance order dated 18.04.2023, arising out of FIR No. 267/2018, Police Station Jyoti Nagar under Sections 420, 468, 471, 473, 201, 120B and 34 IPC, Sections 66, 43, 71, 73, 74 of the IT Act, 2000 and Sections 66C and 66D of the Information Technology (amendment) Act, 2008, along with consequential proceedings, including the chargesheet dated 24.03.2019, pending before the Court of Judicial Magistrate, First Class, Shahdara District. Learned APP appearing for the State, at the very outset, takes objection to the fact that cognizance order has been challenged after more than two years from the date of the order.

Mr. Ajay Kumar Shrivastav, learned counsel appearing for the petitioner, submits that charges have not been framed till date. He seeks permission to withdraw the petition with prayer that directions be issued to the trial Court to expedite the decision on charge. 4.

The statement made by learned counsel is taken on record and petition, along with pending application, is dismissed as withdrawn with direction to the trial Court to make an endeavour to dispose of the question of framing of charge at the earliest.
