% 19.09.2017 IA No.10872/2017 This application under Order 23 Rule 3 CPC is moved by all the parties viz the plaintiff and defendant Nos.1 to 7 stating interalia that the matter has been amicably settled among the parties in terms of the settlement as described in paras No.1 to 28 of the family settlement/compromise dated 05.09.2017. The mode and manner of the division of various properties, including movable and immovable assets, is more specifically given in para Nos.5 to 28 of the settlement dated 05.09.2017 and it include the liabilities, mode of disposal of liabilities, disposal of litigations etc.
It is stated that all the parties have entered into this settlement voluntarily of their own free will, without any coercion or threat from any corner.
Further on 18.09.2017 a supplementary family settlement / compromise is also entered into between the parties which per se is an extension of the earlier settlement dated 05.09.2017. Both the agreements are placed on record in original today in the Court. Both original settlement deeds are exhibited as Ex.P1 and Ex.P2 respectively.
In view of the settlement, the suit of the plaintiff is decreed as compromised. The parties shall be bound by the terms and conditions of both the settlement deeds. Both the agreements Ex.P1 and Ex.P2 shall form part of the decree. Parties to bear their own costs. The pending applications also are disposed of. The date fixed i.e. 30.11.2017 stands cancelled.
