This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "(a) issue writ of mandamus and/or any other writ, order or directions to the Respondent No.1 DoE for ensuring admission of Petitioner in Pre-Primary/KG in Respondent No.2 school for the academic session 2024-25, (b) in the interim, since the academic session has commenced, direct Respondent No.2 to give provisional admission to Petitioner, subject to final outcome of the petition, or in the alternative, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(c) direct Respondent No.1 to reserve a seat in the school of Respondent No.2 for the admission of the Petitioner in PrePrimary/KG class under EWS/DG category..." 2.

The brief facts of the case are that the petitioner belongs to DG category and applied for admission to the KG/Pre-primary class for the academic session 2024-25 under the EWS/DG category with the respondent No. 1. The respondent No. 1 allotted the respondent No. 2 school to the petitioner. However, when the parents of the petitioner visited the respondent No. 2 school, they were not allowed entry inside the premises and were informed that they will receive a call from the school. Pursuant to the Order of this Court dated 25.11.2024, the matter was referred to the District admission monitoring committee, and consequently the petitioner was permitted to continue his studies in the said school.

My attention has been drawn to annexure P-4 of the present petition which is the caste certificate of the petitioner entitling the petitioner to be admitted under the DG category.

In this view of the matter, a mandamus is issued directing respondents to ensure that the petitioner is permitted to continue his education in the respondent No. 2 school under the DG category. 5.

Mr. Moulick, learned counsel for the respondent No. 2, states that the dues of the respondent No. 2 school towards EWS and DG category students are not being cleared by the respondent No. 1. 6.

Along with the aforesaid directions, it is also directed that the respondent No. 2 shall submit all the documents to respondent No. 1 expeditiously within two weeks from today and respondent No. 1 shall after hearing the respondent No. 2 clear the entitled dues of respondent No. 2 expeditiously and not later than four weeks thereafter. 8.

In case there are any shortcomings in the documents and /or anything additional is required, the respondent No. 1 shall inform respondent No. 2 accordingly.

The petition is disposed of in the aforesaid terms, along with pending applications, if any.
