The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No. 10/2018 registered under Sections 498A/406/354/34 IPC at P.S. Khyala, Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between the complainant/respondent No. 2 (wife) and petitioner No. 1 (husband) and petitioner No. 2 is the brother-in-law of the complainant. 3.

Learned counsel for the petitioners submits that the parties have entered into a Settlement Deed dated 16.03.2023. It is stated that the parties have already been granted divorce by mutual consent vide divorce decree dated 24.05.2023 passed by the Family Court, West District, Tis Hazari Courts, Delhi in HMA No. 1622/2023. As per the terms of settlement, it was agreed that a sum of Rs.14,50,000/- as full and final settlement shall be paid by petitioner No. 1 to respondent No. 2. It is informed that the entire Rs.8 lacs have already been paid and the balance amount of Rs.6.50 lacs has been paid today by the petitioner No.1 to the respondent No.2 by way of Demand Draft No.108321, drawn on HDFC Bank, Janakpuri B1 Community Centre, New Delhi.

Petitioner No. 1, who has joined the V.C. proceedings, is identified by his counsel as well as by the I.O.

Respondent No. 2, who has also joined the V.C. proceedings, is identified by the I.O., states that she has entered into the aforesaid Memorandum of Understanding with her own free will, volition and without any coercion.

It is further stated that the parties have no child out of the wedlock. Respondent No.2 is represented in the present matter through her mother Ms. Sunita Kaur, holding Power of Attorney, who is present in the Court, is identified by the learned counsel for respondent No.2 and the IO. 8.
Respondent no.2 further states that she has no objection if the present FIR and consequent proceedings are quashed. In terms of the aforesaid Settlement Deed, respondent No. 2 is now left with no claim whatsoever against the petitioners.

Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and the fact that only charges have been framed and no witness has been examined, no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.

With the above directions, the petition along with pending applications is disposed of.
