O R D E R

The present petition has been filed by the petitioner seeking the following reliefs:

"(I) Issue a writ of mandamus or any other appropriate writ {s), order{s) and or direction (s) thereby setting aside the order dated 21/7/2025 passed by Divisional Commissioner appellate authority in appeal no. 1184/2025/287-290 and consequently direct the Divisional Commissioner to expedite the hearing of the appeal filed by respondent no 2."

By way of the order dated 21.07.2025, the concerned Appellate Authority/Divisional Commissioner has issued interim directions, as under: "Keeping in view of the arguments of both the sides, this appellant authority feels that prima facie stay be granted only to the appellant i.e. Smt. Parul Atrish against the Order of Ld. District Magistrate (SouthWest) dated 31.05.2025, till disposal of the appeal, as the appellant has a minor daughter who might suffer if the stay is not granted at this preliminary stage. Matter will be heard on final arguments on the next date of hearing."

Learned counsel for the petitioner submits that grave prejudice has been caused to the petitioner on account of the aforesaid interim order, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. inasmuch as, pursuant thereto, the respondent has re-entered the property in question and has been subjecting the petitioner (senior citizen) to immense and continuous harassment thereafter.

It is noticed that the order dated 21.07.2025 is only in the nature of an interim direction. The Appellate Authority is yet to examine the pending appeal on merits.

Considering the circumstances pointed out by the petitioner, the petition is disposed of with the request to the concerned Appellate Authority / Divisional Commissioner to dispose of the appeal, filed by the respondent no. 2, as expeditiously as possible and preferably within a period of eight weeks from today.

Let the Appellate Authority / Divisional Commissioner schedule dates at short intervals, with a view to endeavour/ adhere to the aforesaid timeline. 7.

The petition is disposed of in the above terms. 8.

Needless to say, all contentions of the parties shall be considered by the Appellate Authority / Divisional Commissioner. 9.

The petitioner would also be at liberty to move an application before the Appellate Authority / Divisional Commissioner for expeditious hearing in the matter, in line with the aforesaid directions. 10.
