% 31.10.2025 CM APPL. 67870/2025 By way of the present joint application filed under Order XXIII Rule 3 read with section 89 of the Code of Civil Procedure 1908 ('CPC'), the parties seek disposal of the present regular second appeal in terms of Memorandum of Understanding ('MoU') dated 29.10.2025, whereby they have amicably resolved their inter-se dispute.

The appellant and the respondent are also present in court. 3.

Mr. Tushar Pahwa, learned counsel appearing for the appellant submits, that the appeal may be disposed-of as infructuous in terms of the settlement contained in the MoU.

A statement dated 15.09.2025 recorded by the learned executing court whereby the respondent has withdrawn the execution petition has also been appended to the application.

In view of the submissions made, the application is allowed and disposed-of.

In view of the above, the present appeal is disposed-of in terms of MoU dated 29.10.2025.

Pending applications, if any, stand disposed-of. 9.

As prayed-for by Mr Pahwa, learned counsel for the appellant, in terms of Section 16-A of the Court Fees Act, 1870 (as applicable to Delhi), the Registry is directed to refund 50% of the amount of court fee affixed in the Memo of Appeal to the appellant. 10.

The Registry is directed to draw-up the requisite certificate in favour of the appellant within 02 weeks.

The date of 04th November 2025 before the learned Joint-Registrar stands cancelled.
