A report regarding interaction of Child Welfare Committee (CWC) with victim „S‟ has been filed wherein it is mentioned that after interaction with the victim, the victim has individually expressed her desire to give birth to the child and thereafter live with her bua only. She has also further desired to stay at Nirmal Chhaya till giving birth to the child. 2.

During interaction with the concerned doctor on the last date, she had categorically stated that the victim is physically and mentally fit to give birth to the child.

In these circumstances, this Court in the best interest of the victim, in view of the report of the Medical Board and interaction of CWC with the victim holds that no urgent orders are required for medical termination of pregnancy as the victim wants to give birth to the child. However, the present case has once again brought to forth certain lapses and omissions to comply with orders of this Court.
