Present public interest petition has been filed seeking directions to the Respondents to restrain cluster buses from plying through the Yamuna Vihar residential colony ('colony') and to restrict entry of all heavy motor vehicles in the colony.

The petitioner, who had appeared in person in the morning session, had admitted that after the last date of hearing cluster buses have stopped plying through the Yamuna Vihar residential colony. He had however stated that he would like to press prayer 'B' in the writ petition, wherein the petitioner has prayed for a direction to the respondents to restrict entry of all heavy motor vehicles in Yamuna Vihar residential colony. This fact has also been confirmed by the learned counsel for the Respondents. development Petitioner stated that prayer 'A' in the petition stands satisfied. 3.

At that stage, this Court had pointed out to him that he had not made any prior representation to the respondents with regard to prayer 'B'. 4.

The petitioner had sought a pass over to check his records and inform this Court as to whether any representation or notice had been given with regard to prayer 'B'.

However, at the pass over stage, the petitioner is not present. Accordingly, the present writ petition and application are disposed of with liberty to the petitioner to file a representation/legal notice with the respondents with regard to prayer 'B' of the writ petition. In the event, such a representation / legal notice is filed by the petitioner within two weeks, the same is directed to be disposed of by the respondents by way of a reasoned order in accordance with law within eight weeks. The rights and contentions of all the parties are left open.
