% 22.03.2018 The petitioner is the wife of the respondent, their marital ties having run into rough weather. The respondent / husband has filed a case for divorce (HMA 1161/2017) which is pending in the court of the Principal Judge, Family Court, South-East district at Saket Courts Complex, New Delhi.

The petitioner is presently the ordinary resident of Lawrence Road area of Delhi which falls within the territorial jurisdiction of the Family Court for North-West at Rohini Courts Complex. The respondent / husband who has initiated the said divorce case was living in the area Kalkaji, New Delhi when the case was filed though it has been explained by the counsel at the hearing that he has shifted residence elsewhere. Be that as it may, given the fact that the petitioner is the respondent in divorce case, the prayer for TR.P.(C.) 26/2018

transfer is granted. The divorce case as aforesaid is withdrawn from the court of the Principal Judge for South-East District at Saket Courts Complex, New Delhi and made over for further proceedings in accordance with law to the court of the Principal Judge, Family Courts for North-West district at Rohini Courts Complex, New Delhi. The transferor court shall send the file to the transferee court fixing an appropriate date for the parties to appear there. The Principal Judge, North-West district at Rohini Courts Complex will have the discretion to retain the case in his court or allocate it to the court of the Additional Judge, Family Court under his control.
