IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 950/2018 SAHIL DHINGAAN ..... Petitioner Through :
Mr Pramod K.Tripathi, Advocate.
versus STATE (GOVT OF NCT OF DELHI) & ANR ..... Respondent Through :
Mr Mukesh Kumar, Addl. PP for the State.
CORAM:
HON'BLE MR. JUSTICE SANJEEV SACHDEVA
O R D E R
% 05.04.2018 1.
Petitioner seeks quashing of FIR No.704/2015 under Sections 354(D)/509 IPC, Police Station Kalyan Puri, based on a Settlement. 2.
Parties are neighbours and known to each other. 3.
Parties have settled their disputes with the intervention of the respectable members of the locality.
4.
Respondent No.2 is present in Court in person, identified by the Investigating Officer, submits that she has settled with the petitioner and does not wish to press her complaint any further. Crl.M.C.950/2018
5.
In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable members of the Society with a view to restore peace and harmony between them and a Settlement has been arrived at between the parties, and further respondent No.2 does not wish to press charges against each other, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
6.
Accordingly, FIR No.704/2015 under Sections 354(D)/509 IPC, Police Station Kalyan Puri and the consequent proceedings emanating therefrom are hereby quashed.
