Counsel for the plaintiff states that during the pendency of the present suit, the parties have arrived at an out of court settlement and he has instructions to withdraw the present suit.

Counsel for the defendant No.1 confirms the fact that his client has arrived at a settlement with the plaintiff.

In view of the above, the present suit is dismissed as withdrawn, along with the pending applications.

The date already fixed in the suit, i.e.,20.7.2016 stands cancelled. I.A. No.4582/2016 (u/Secs.16 and 16A of the Court Fees Act) 1.

The present application has been filed by the plaintiff for refund of court fees.

Counsel for the plaintiff states that evidence has yet to be recorded in the suit and the plaintiff is entitled to refund of 50% court fees under Section 16A of the Court Fees Act. Ordered accordingly. 3.
