These petitions assail an order dated 08.11.2023 passed under Section 338 of the DMC Act, 1957 (in W.P.(C) 239/2024) as also a Show-cause notice dated 06.12.2023 under Section 341(1) and 343of the DMC Act, 1957 (in W.P.(C) 176/2024) 2.

Admittedly, the aforesaid orders are appealable before ATMCD. Accordingly, the present petitions are disposed of with the liberty to the petitioner to initiate appropriate proceedings before ATMCD which shall be duly considered by the ATMCD in accordance with law. In the interregnum, no precipitative or coercive action shall be taken by the MCD for a period of 2 weeks from today, and status quo shall be maintained by the parties in respect of the property in question. 4.
