% 18.07.2018 Pursuant to order of this court dated 2.4.2018 learned counsel for the defendant has in court placed on record an affidavit of the Managing Director of the respondent company who has undertaken that defendant No.1 does not intend to infringe the trademark of the plaintiff. It has also been pointed out that the defendant No.1 is now selling its product under the mark "EPS Toilet". It is also stated in the affidavit that the defendant has changed the domain name from www.etoilet.biz to a new domain name. The affidavit of Mr.P.Kubendran the Managing Director of the defendant No.1 is taken on record. Defendant shall remain bound by the undertaking given today.

Suit is accordingly disposed of. The affidavit is sent to the Registry for being scanned and placed on record.
