O R D E R
% 28.09.2018 In the present suit, the parties have resolved their disputes vide settlement agreement dated 30th January, 2018. The settlement agreement was entered into under the aegis of Delhi High Court Mediation and Conciliation Centre. The terms of settlement are contained in para (i) to (viii) of the settlement agreement. The settlement agreement covers disputes forming part of CS(OS) 552/2018 and CS(OS) 518/2017 pending before the District Courts, Saket. The agreement has been signed by the parties. As per the settlement, the first instalment of the payment as per para ii(a) has already been made. Insofar as the second payment is concerned, the same is being handed over today by means of account payee cheque along
with the interest in terms of order dated 29th May, 2018. The cheques have been handed over to the counsel for the Plaintiff today in Court. The authorised signatory of the Plaintiff Company - Ms. Niharika, Manager Legal is present in Court today and acknowledges the receipt of the cheques. Ld Counsel assures that the cheques handed over today shall be honoured. The terms of settlement shall be binding on the parties and any one acting on their behalf in terms of para (v). The Defendant shall remove the title from its website and not use the same in any manner as provided in the Agreement.
The suit is decreed in terms of the settlement. Decree sheet be drawn. The Court fee is refunded in full in view of the mediation. PRATHIBA M. SINGH, J SEPTEMBER 28, 2018 Rahul
