By order dated 31st May, 2017, this Court had directed the Appellant to deposit the entire decretal amount and subject to the same, the impugned judgment and decree dated 24th January, 2017 in Civil Suit No. 313/2016 was stayed.

The Registry has reported that the decretal amount has not been deposited and it appears that no steps have been taken to serve the Respondent. On the last date, a submission was made by learned counsel for the Appellant that the matter was referred to the Mediation Centre, Karkardooma Courts.

None is present on behalf of the Appellant today. It appears that the Appellant is not interested in prosecuting the appeal. Accordingly, the appeal is dismissed for non-prosecution. PRATHIBA M. SINGH, J.
