By way of present bail application, the applicant seeks regular bail in FIR No. 154/2024 registered under Sections 392/394/397/411/34/120B IPC and 25/27 of the Arms Act at Police Station Narela, Delhi. 2.
Learned counsel for the applicant submits that the applicant is in custody since 23.02.2024. He further submits that though the charge-sheet has already been filed, however, charges are yet to be framed. It is stated that prosecution has cited 32 witnesses and the trial will likely to take a long time. It is further stated that the applicant is not involved in any other case. On merits, learned counsel for the applicant submits that as per the prosecution case, the role attributed to the present applicant is of informing one Lokesh @ Loki about the withdrawal of the money by the complainant. two more accused persons and together they had committed the robbery. Learned counsel for the applicant contends that the applicant was not present at the spot and the amount of Rs.2 lacs which is alleged to have come to the applicant's share already stands recovered. It is also stated that the coaccused Lokesh @ Loki has already been released on regular bail by the Trial Court vide order dated 30.08.2024.

The bail application is opposed by learned APP for State. While referring to the status report filed before the Trial Court, copy of which is already placed on record, it is stated that by the learned APP that it is on account of the present applicant that the information about withdrawal, that the complainant was going to make, was leaked and eventually the robbery came to be committed.

Considering the totality of the facts and circumstances, and the fact that the applicant has not been found at the spot, it is directed that the applicant be released on regular bail subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/Duty M.M. and subject to the following further conditions :- i) The applicant shall not leave the NCR without prior permission of the concerned Court.
ii) The applicant shall provide his mobile number to the Investigating Officer on which he will remain available during the pendency of the trial. iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court.

Needless to state that this Court has not expressed any opinion on the merits of the case and has made the observations only with regard to present bail applicant and nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present bail application.
