The present bail application has been on behalf of applicant under Section 439 r/w Section 482 Cr.P.C. seeking regular bail in case FIR No. 392/2024 under Section 308/34 IPC registered at PS Mukherjee Nagar.

Learned counsel for the petitioner submits that the petitioner is a final year student of Faculty of Law, University of Delhi and is in judicial custody since 10.08.2024. Learned counsel submits the incident on 22.05.2024 had taken place on account of election rivalry and a cross case was also registered against the complainant party. Learned counsel submits that the injuries on the complainant are simple in nature. It has further been submitted that if the petitioner is not released on bail he may end up spoiling his entire academic year. Learned APP has opposed the bail application on the ground that since the complainant party and the petitioner study in the same college there is a possibility that the petitioner may attack the complainant again. Learned APP also submitted that the petitioner is the main person who attacked the complainant and is also not cooperating in the investigation.

It is a matter of record that the charge-sheet in the present case has already been filed under Section 323/341/308/34 IPC. The petitioner is in custody since 10.08.2024. It has been submitted that there are no other criminal antecedents against the petitioner and the petitioner is a student of final year student of Faculty of Law, University of Delhi. The law classes are in session. Taking into account the facts and circumstances, the petitioner is admitted to regular bail on furnishing a personal bond of Rs. 20,000/- with one surety of the like amount subject to the satisfaction of Ld. Trial Court subject to the following conditions:

a) the Petitioner shall cooperate in the investigation and appear before the Investigating Officer of the case on every Friday at 05:00 P.M and as and when required;

b) the Petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case;

c) the Petitioner shall provide his/her mobile number(s) to the Investigating Officer;

shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit.

Copy of this order be sent to concerned Jail Superintendent for information and necessary compliance.
