An application under Section 438 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of Anticipatory Bail in FIR No.14447/2024 under Section 379 IPC registered at P.S: Mundka.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

In brief, as per the case of prosecution, complainant was lured to hand over/park his truck, which was stolen and misappropriated by co-accused Sunil and Iftakhar who were subsequently arrested in another case. It is further the case of prosecution that the truck is yet to be recovered. 4.

Learned counsel for the petitioner submits that efforts were made by petitioner to join the investigation but he could not meet the Investigating Officer. He further submits that petitioner has no knowledge about the truck. On the other hand, learned APP for the State vehemently opposes the application and submits that since truck in question is yet to be recovered, custodial interrogation of the petitioner is necessary. 6.

The custodial interrogation of the petitioner cannot be ruled out since the truck is yet to be recovered and the same is disclosed to have been handed over by co-accused Sunil to the petitioner. Considering the facts and circumstances and evidence on record, no grounds for anticipatory bail are made out.

Application is accordingly dismissed. Pending application, if any, also stands disposed of.
