% 26.11.2018 This petition seeks quashing of FIR No.566/2017, P.S. New Ashok Nagar under sections 420/34 IPC registered on a complaint of one policeman complaining that he has advanced an interest free loan of Rs.20 lacs to the petitioner through banking transaction but the petitioner had not returned the loan amount. The learned counsel for the petitioner states that there is no cause for registering the FIR because not only the entire amount of Rs.20 lacs but an additional amount of Rs.6,94,480/- has also been repaid to the complainant/ loan giver viz. Mr. Shivraj Singh Rawat on 07.06.2016, as per the bank statement of payments at page 37 of the paper-book. Mr. Avi Singh the learned Additional Standing Counsel for the State submits that after the petitioner had paid Rs. 19.5 lacs to the

complainant from 05.04.2016 to 17.06.2016, an amount of Rs.20 lacs was again transferred into the account of the petitioner on 08.06.2016, by the complainant and there is a loan transaction between the parties and an agreement dated 06.06.2016, to the effect that the said money has been given as interest free loan to the petitioner. He submits that as per the investigation thus far, there appears to be multiple transactions between the parties. The investigation is likely to be completed in two weeks' time.

In view of the above, the learned counsel for the petitioner does not press the petition on merits at this stage. It is disposed off accordingly. Liberty granted to approach the Court at an appropriate stage.
