% 15.03.2018 EX.APPL.(OS) 72/2018 This is an application filed under Order 23 Rule 3 read with Section 151 CPC on behalf of the parties. The decree holder has filed the captioned Execution Petition seeking execution of Decree dated 17.04.2009 in C.S.(O.S) No.189/2009 titled "Shri Puneet Parkash Vs. Shri Jai Parkash & Ors." The said decree is of Partition, Rendition of Accounts and Permanent Injunction in relation to joint family properties detailed in the Plaint.

The matter was referred to the Delhi High Court Mediation & Conciliation Centre and an amicable settlement has been arrived at in terms of the family settlement dated 15th April, 2009. Pursuant to this Court vide order dated 17th April, 2009 had decreed the suit. The parties declared and undertake they shall be bound by the terms of family settlement and in case of any breach and non-compliance

either of the parties shall have a right to revive the present execution proceedings. The family settlement dated 15th April, 2009 is on record.

In these circumstances, the execution proceedings stands disposed of with the direction to parties to abide by the terms of family settlement dated 15th April, 2009.

The petition stands disposed of.

The earlier date fixed stands cancelled.
