The Petition under Section 528 of BNSS, 2023 has been filed on behalf of the petitioner for setting aside the Summoning Order dated 29.05.2024 qua the petitioner, passed by the learned Metropolitan Magistrate, South, Saket Courts, Delhi in Compliant Case No. 901/2024. Essentially, the Summoning Order has been challenged on the ground that the petitioner was the Director and not a signatory to the cheque and was not involved in any manner with a day-to-day management of the affairs of the company.

Learned counsel on behalf of the respondent has submitted the copy of the Affidavit wherein it is stated that the complainant does not intend to pursue his Complaint against the present petitioner. Let the same be taken on record.

In view of the affidavit and the statement given on behalf of the respondent, the Summoning Order viz a viz the petitioner, Ms. Ranjana Singh is hereby set aside and the Petitioner is discharged. 4.

The Petition is accordingly allowed and disposed of. The pending application also stands disposed of.
