% 03.03.2025 CRL.M.A. 6854/2025 (by the petitioner under Section 528 of BNSS, 2023 seeking modification of order dated 06.09.2024) 1.

The present application has been filed seeking modification/correction of order dated 06.09.2024.

The learned counsel appearing on behalf of the petitioner submits that vide aforesaid order dated 06.09.2024, the FIR in question was quashed by this court, however, the year of the FIR has been wrongly mentioned in paras 3, 4 and 18 of the said order as '2018' instead of '2021'. This position is not disputed by the learned APP appearing on behalf of the State. 3.

In view of the above, paras 3, 4 and 18 of the order dated 06.09.2024 are corrected to read as under:

The present Petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking to quash the FIR No. 323/2021 registered under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 07/03/2025 at 12:27:10

Sections 354A/509 of the Indian Penal Code, 1860 (hereinafter referred to as "IPC, 1860") and Section 10 of POCSO Act at Police Station Geeta Colony, Delhi.

Brief facts of the case are that the complainant/respondent No. 2 has made a complaint to the Police Officials stating therein that my father tortured me and my mother. He beats us and also gives abuses. He tries to touch me inappropriately and he does not give us maintenance and repeatedly tries to throw out us from the house. He used to demand dowry from my mother and maternal uncle. Whenever I see him I start trembling and my oxygen level goes down. He endangers to our lives and he should be put behind bar otherwise he will kill us and also torture us. On the basis of the said complaint, the present an FIR bearing No. 323/2021 under Sections 354A/509 of the IPC, 1860 and Section 10 of POCSO Act got registered at Police Station Geeta Colony, Delhi and also the Chargesheet has been filed in the said FIR, which is pending before the learned Trial Court Delhi. xxx xxx xxx 18.

Accordingly, FIR bearing No. 323/2021 registered at Police Station Geeta Colony, Delhi, for offences punishable under Sections 354A/509 of IPC, 1860 and Section 10 of POCSO Act and the Chargesheet and all consequential proceedings emanating therefrom are quashed."
